Terms of service

These terms are the agreement between you (the business using Retensive) and Retensive. They're written to be read, not skimmed past. By creating an account or using the service, you're agreeing to them. If you're signing up on behalf of a company, you're agreeing on the company's behalf.

01The service

Retensive is a platform for storing your contacts, segmenting them, creating email campaigns, and sending them at scale — with delivery controls, suppression handling, and analytics built in. The details of what's included in your plan are set out when we agree your plan together.

02Your account

  • Give us accurate information when you sign up and keep it current.
  • Keep your credentials safe. Anything done through your account is your responsibility, so use the role controls we provide.
  • You must be at least 18 and using Retensive for business purposes.

03Permission-based sending — the rules that matter most

Retensive exists to get more value from audiences you already own — not to blast strangers. These rules are strict because your deliverability, and every other customer's, depends on them:

  • Only email people who gave you permission. They signed up, bought from you, or otherwise clearly agreed to hear from you.
  • No purchased, rented, or scraped lists. Not even once. Not even “opted-in” lists from a third party.
  • Honor every unsubscribe. Retensive enforces this automatically and adds a working unsubscribe link to every email. Don't work around it.
  • Be who you say you are. Accurate sender names, accurate subject lines, a real reply path, and your genuine business identity.
  • Follow the law where your recipients are. CAN-SPAM in the US, GDPR and ePrivacy in Europe, CASL in Canada, and their equivalents elsewhere.
  • No prohibited content. Nothing illegal, deceptive, or harmful — including phishing, malware, and content that misleads recipients about what they're getting.

If a send puts recipients or the platform at risk, we can pause it, require a list cleanup, or suspend the account. For clear-cut spam or abuse we'll act immediately; otherwise we'll contact you first.

04Your data stays yours

  • Your contact lists, content, and campaign data belong to you.
  • You give us permission to process them — only to provide the service, as described in our privacy policy.
  • You're responsible for having the right to upload and use the data you bring to Retensive.
  • You can export your data at any time, and when you leave, we delete it on the timelines in our privacy policy.

05Fees and billing

Plans and pricing are agreed directly with us and set out in your order. Invoices are due on the terms stated there. If an invoice goes unpaid, we'll remind you before we suspend anything.

06Keeping the platform healthy

We monitor complaint rates, bounce rates, and provider feedback across the platform. That's a feature — it protects your sending reputation and everyone else's. It also means we may throttle, pause, or block sends that trip those signals, and we'll tell you when we do.

07Deliverability

Nobody can guarantee inbox placement — anyone who says otherwise is selling something. Retensive gives you the controls that meaningfully improve it: pacing, canary sends, seed monitoring, suppression hygiene. What we promise is the tooling, not a placement rate.

08Availability and changes

We work hard to keep Retensive fast and available, and we'll evolve features over time. The service is provided as-is: we don't promise it will be uninterrupted or error-free, and we may add, change, or retire features. If we retire something significant, we'll give you reasonable notice.

09Intellectual property

The Retensive platform, brand, and everything we've built is ours. Your content and data are yours. If you send us feedback or ideas, we can use them to improve the product without owing you anything — though we appreciate them.

10Ending the agreement

  • You can stop using Retensive and close your workspace at any time. Export your data first — we'll help if you need it.
  • We can suspend or terminate accounts that breach these terms. For serious breaches — spam, abuse, illegal content — that can be immediate. For anything else, we'll give you notice and a chance to fix it.
  • After closure, your data is deleted on the timelines in our privacy policy.

11Liability

In plain terms: we're not liable for indirect losses like lost profits or lost data caused by things outside our control, and our total liability to you is capped at the amount you paid us in the twelve months before the claim. Nothing in these terms limits liability that can't legally be limited.

12Governing law

These terms are governed by the laws of India, and disputes will be resolved in the courts there. If your order form says otherwise, the order form wins.

13Changes to these terms

If we change these terms, we'll update the date at the top and notify customers of significant changes before they take effect. Continuing to use Retensive after that means you accept the updated terms.
